Terms and Conditions

Welcome to Elixia Skin Pro. These Terms and Conditions govern your access to and use of the platform. By creating an account or using the platform, you agree to these terms.

1. About Elixia Skin Pro

Elixia Skin Pro is a technology platform that connects customers with independent clinics and practitioners for aesthetic, beauty, and wellness care. Unless expressly stated, Elixia does not itself provide the clinical services listed on the platform, and it does not practice medicine.

2. Eligibility

Users must be at least 18 years old, or have the consent of a parent or legal guardian where the law allows that.

3. Accounts

Customers, practitioners, and clinic staff each have an account. You are responsible for keeping the login confidential and for keeping the account information accurate. A clinic is responsible for the staff it allows onto its account. Activity under those credentials is treated as the account holder's.

4. Using the platform

Customers may browse clinics, practitioners, and treatments in the country market they are viewing, request a booking, and pay. Clinics and practitioners may publish a listing, manage bookings, and receive payment, subject to the fees shown before a charge is made.

5. Independent clinics and practitioners

Clinics and practitioners on the platform are independent. They are solely responsible for the quality and execution of their services, for holding the licenses their work requires, and for the clinical judgment in a visit. Elixia does not employ them and does not supervise the care they provide.

6. Bookings

A booking is confirmed only after the clinic or practitioner accepts it. Sending a request, or paying for a package where the terms say a later session still needs a time, does not by itself mean the visit is confirmed.

7. Payments

Payments are processed through supported third-party payment providers. Applicable taxes and service fees may apply. The price of a service or package is shown before you pay. Package terms, including what the package includes, are shown before purchase.

8. Cancellations and refunds

Cancellation and refund eligibility follow the clinic's stated policy and applicable law. Elixia may carry out a refund the clinic approves or that the law requires. A dispute about the care itself is between the customer and the clinic or practitioner who provided it.

9. Listings

Clinics and practitioners are responsible for the accuracy of the services, prices, credentials, availability, and photographs they publish. Elixia may refuse or unpublish a listing that is misleading or that breaks these terms.

10. Conduct

Users must not engage in fraud, harassment, unlawful activity, or attempts to compromise the security of the platform. Do not post another person's health information, photographs, or reviews unless you have the right to do so.

11. Ratings and reviews

Reviews must be truthful, respectful, and based on an actual experience. Elixia may remove a review that is abusive, that is not about a real visit, or that discloses someone's health information without a right to do so.

12. Intellectual property

The platform, its design, and its text are owned by Elixia Skin Pro or its licensors and may not be copied or reused without permission. A clinic or practitioner keeps ownership of the listing content it uploads, and grants Elixia a license to display that content on the platform for as long as the listing is published.

13. Privacy and health information

The Privacy Policy and the HIPAA Notice are part of these terms. They describe how account, booking, and health information is handled for customers, practitioners, and clinic teams. The platform is not an emergency service.

14. Communications

You agree to receive service messages about an account, a booking, or a change to these terms. Marketing messages, where they are sent, are optional and are not a condition of booking or paying for a service.

15. Limitation of liability

To the fullest extent permitted by law, Elixia is not liable for the clinical outcome of a service provided by an independent clinic or practitioner, or for a loss that was not a direct result of using the platform. Where liability cannot be excluded, it is limited to the fullest extent the law allows.

16. Disclaimer

The platform is provided “AS IS” and “AS AVAILABLE,” without warranties of uninterrupted access or of a particular clinical result.

17. Indemnification

You agree to indemnify Elixia against claims that arise from your misuse of the platform, from a listing or review you publish, or from a service you provide through the platform.

18. Suspension and termination

Elixia may suspend or close an account that breaks these terms. You may ask for your own account to be closed in the app, or through the delete-account page. Closing an account does not erase records a clinic is required to keep.

19. Changes to the platform

Elixia may modify or discontinue platform features at any time.

20. Changes to these terms

Updated terms apply from the time they are published on this page. Continuing to use the platform after that is acceptance of the updated terms.

21. Governing law

These terms are governed by the laws of the Republic of the Philippines. That choice does not take away mandatory consumer or healthcare protections in the country where a visit takes place, including United States health-privacy rules where they apply to a clinic.

22. Disputes

The parties will try to resolve a dispute in good faith before starting litigation. A dispute about the care itself is taken up with the clinic or practitioner who provided it.

23. Force majeure

Elixia is not liable for a delay or failure caused by an event beyond its reasonable control.

24. Severability

If any provision is found invalid, the remaining provisions stay in effect.

25. Entire agreement

These terms, the Privacy Policy, and the HIPAA Notice are the entire agreement about use of the platform.
